As requested by lots of VERE members at the conference “Product Responsibility – a solvable Challenge?" on November 17th, 2011 in Berlin, the VERE Association is offering another service. From now on you have the option to take actions against market participants that are not registered according to the German Electrical and Electronic Equipment Act (ElektroG), the Packaging Ordinance (VerpackV) or the Battery Act (BattG) contrary to their obligations.

To do so, we have concluded a framework agreement with the Verein für lauteren Wettbewerb e.V. (VflW) (= Association for fair competition) in Hamburg, in order that you may proceed against such free riders free of charge. From now on, the contract allows you to enforce declarations of discontinuance against free riders by means of warnings of the Association for fair competition if it is possible to actually prove the unfair competition in a form that it can be used in court.

The Association for fair competition is classified as serious and has capacity to bring proceedings at all courts in Germany. In this way, it is possible to exclude dubious warnings.

Collection of used mobile phones in Bavaria in cooperation with the StMUG and Eficom The VERE Association and the company take-e-way GmbH support the collection of mobile phones "Disposing of mobile phones in a clever way" which is performed under the auspices of the Bavarian States Ministery for Environment and Health (StMUG) together with the project association Eficom with about 7’000 collection points in government agencies, schools, district offices, municipalities, associations, churches and companies of the republic of Bavaria. The collection is starting after today's press conference of the STMUG at the grammer school Oskar-von-Miller in Munich Schwabing; at the occasion of this press conference the State Minister Dr. Marcel Huber presents the overall concept of the collection of used mobile phones. The collection "Disposing of mobile phones in a clever way" is supposed to be the largest collection of mobile phones in Germany. As soon as the revised directive of the European Parliament and of the council on waste electrical and electronic equipment (WEEE directive) will be binding for all manufacturers and importers of solar and PV modules, the producers will need help in particular when implementing the German version of the WEEE directive, the Electrical and Electronic Equipment Act (ElektroG). After the implementation of the “WEEE2” in the countries of the European Union, the requirements and obligations are already applicable before selling solar and PV modules and not only when recycling them after many years of operation. In particular in Germany PV manufacturers and importers have to prove a guaranty that they are protected from insolvency for the advised sales volume and have to handle comprehensive reporting and registration obligations. Additionally, it is necessary to provide an extensive waste disposal network in order to be able to process possible recycling requirements in a timely and qualitative manner complying with the law.

Furthermore, the government mentions that according to the prevailing opinion these nicotine products are not regarded as tobacco products. Therefore, the exception for tobacco products provided in the German Medical Act is not applied. The government explains that according to their opinion the placing of nicotine depots, tanks or liquids, to be used in e-cigarettes without statutory approval for pharmaceutical products would violate the German Medicine Act. This does not apply for the mere use of e-cigarettes containing nicotine. However, according to the stipulation of the law for the protection of non-smokers in the federal republic prohibits smoking even of e-cigarettes in federal agencies in public, means of transportation and train stations. Due to the corresponding laws for the protection of non-smokers there may be other limitations in the different countries. According to the Federal Government e-cigarettes are products, at which an evaporating liquid is inhaled when smoking. The inhaled vapor shall be experienced similar to tobacco smoke. In the reply it further says that contrary to conventional cigarettes no combustion is taking place. The liquid may contain nicotine, flavoring agents, ethanol, glycerin and/or other humectants such as propylene-glycol. The government says there are “references that carcinogenic substances (e.g. formaldehyde, acetaldehyde and acrolein) are being formed when the liquids are vaporing and their concentrations are above the admissible limit values for interior spaces, when inhaling the vapors during examinations.” The government says further on that the cigarette body of the e-cigarettes (without nicotine solution) “should be classified as medical product with charging device and nebulizer, if the manufacturer determines that it is being used to administer a nicotine solution which is classified as medicine product”. If the nicotine depot is firmly related with the e-cigarette and not determined to be re-used, “the e-cigarette is classified as medicinal product and not as medical product”, it says in the answer further on. The most important points from our point of view in brief:
The ElektroStoffV (Regulation on substances in electrical and electronic devices) prohibits the placing of electrical devices and electronic devices (incl. spare parts, etc.) on the market which include more than 0.1 percent per weight of lead, mercury, hexavalent chromium, polybrominated biphenyls (PBB) or polybrominated diphenyl ethers (PBDE) or more than 0.01 percent per weight of cadmium per homogeneous material. The proof for this is submitted in form of an EU declaration of conformity related with a CE marking. Manufacturers and importers shall place devices only on the market if these declarations of conformity are available. Distributors have to check this with "due diligence" before placing such devices on the market. This regulation will presumably come into force since it implements the EU directive 2011/65/EU. Only slight changes are to be expected. We will ask the BMU to explain the term "homogeneous material” in more detail.
