Battery law in the Environment Committee

After an initial debate, the German Bundestag referred the bill to the Environment Committee for further discussion. Prior to this, the Federal Cabinet had approved the draft bill submitted by the Federal Ministry for the Environment for a law to harmonise national law with the EU Batteries Regulation.

As reported by the Bundestag, it discussed battery law on 26 June 2025. To this end, the CDU/CSU and SPD coalition parties presented a bill to adapt battery law to Regulation (EU) 2023/1542 (“Batterierecht-EU-Anpassungsgesetz”, 21/570). After an initial debate, the Bundestag referred the bill to the Environment Committee for further discussion. Previously, on 18 June 2025, the Federal Cabinet had approved the draft law submitted by the Federal Ministry for the Environment, Nature Conservation and Nuclear Safety (BMUKN) to adapt national law to the EU Batteries Regulation, as reported by Euwid.

On 27 May 2020, the Federal Ministry for the Environment (BMUKN) published a revised draft bill for a law to adapt national battery law to the new EU Batteries Regulation (EU) 2023/1542 (VERE e.V. reported: Battery law: new draft published). This specifies the requirements for producers, take-back systems and authorities and replaces the draft from April 2024, which was passed by the old German government but could not be finalised due to the early elections. The requirements of the EU Batteries Regulation from Section 8 (waste management) must be transposed into national law by 18 August 2025. The Batteries Regulation has been directly applicable in all member states since February 2024. The separate national regulations are intended to implement the opening clauses for national legislators provided for in the regulation as well as specific regulatory mandates addressed to the member states.
