Until 11:59 p.m. on 15 January 2026, all battery producers registered with the EAR foundation (German WEEE and battery registration board) were required to participate in a so-called producer responsibility organisation (PRO / OfH) for the batteries they placed on the market. This obligation applies to batteries of all battery categories, wrote the EAR in its latest newsletter. The deadline for battery producers to participate in an OfH expired on 15 January. If you have not yet registered your quantities with an OfH, please do so immediately. Otherwise, you will lose your battery registration by law on 16 January. Companies that register their batteries via take-e-way do not need to take any action, as take-e-way has taken care of updating the registration.
On 15 January 2026, the EAR announced that it expects the vast majority of battery producers to have registered their battery quantities with an OfH by the above deadline.
If you have lost your battery registration in this context but still need it, you can apply for a new registration.
The EAR Foundation has indicated that the processing time for new battery registrations can be as little as one week, provided that the application is complete.
This also means that the feared standstill in the battery market is no longer an issue, as the EAR Foundation has made arrangements for a smooth transition to the new BattDG regulations: "The efforts of all those involved have definitely paid off. In the area of device batteries, 92% of all registrations were retained. That is a very good rate," says Dr Andrea Menz, Chief Representative of the EAR Foundation.
