ElektroStoffV – Federal Government adopts the draft for the Material Ordinance for Electrical and Electronic Equipment

The RoHS directive must be implemented into national law until January 2nd, 2013, i.e. the Material Ordinance for Electrical and Electronic Equipment (ElektroStoffV) should have come into force until that date.

End of September the German Federal Government adopted the draft for the Material Ordinance for Electrical and Electronic Equipment (ElektroStoffV). The ordinance shall implement the new European RoHS directive on the “restriction of the use of certain hazardous substances in electrical and electronic equipment” in national law which came into force in July last year.

Due to the comprehensive operative contents of the new RoHS directive 2011/65/EU an independent directive was selected for its realization. The directive obliges the member states to make sure that the marketed electrical and electronic devices, cables and spare parts no longer include certain dangerous substances.

The member states have to take care that manufacturers show a corresponding EU declaration of conformity and apply an EC marking on the device. Furthermore, the manufacturer has to comply with certain documentation and information obligations. The manufacturer can transfer these obligations to a representative.

Beside the manufacturer, the regulation also calls on the distributors. They have to check in particular if the devices comply with the limit values for pollutants.
